Our real estate department provides clients with experience in a variety of areas. We represent sellers, purchasers, lenders, developers, landlords and tenants in the acquisition, sale, lease, development, and financing of commercial and industrial properties. We assist clients through the acquisition and development process, including negotiation of contracts, entity formation, title review, and financing.
Along with a Qualified Intermediary, we often assist clients in tax-deferred exchanges. Our attorneys often serve as lender’s counsel or borrower’s counsel in connection with commercial financing. We draft and negotiate loan documents in complex commercial financing transactions.
Real Estate Litigation
Our team has the ability to cover a wide variety of real estate related disputes as well. We advise our clients on strategies to avoid litigation and encourage practical resolutions, however when litigation is in our clients best interest or cannot be avoided, we represent our clients in litigation matters such as contract disputes, commercial foreclosures, development issues, government takings, quiet title litigation, and title insurance claims and defense.
Local Counsel/Legal Opinions
We often serve as local counsel for clients and other law firms in connection with commercial transactions which require a South Carolina opinion letter. Our attorneys are knowledgeable about South Carolina law and lender issues and frequently collaborate with attorneys in other states to assist with commercial transactions.
Our attorneys also have considerable experience representing lenders and borrowers in connection with SBA financing and other government guaranteed loan programs.
Our attorneys represent both landlords and tenants in commercial leasing, including negotiation of leases for office space, shopping centers, and free-standing retail.
Residential Real Estate
Our real estate department also provides clients, lenders and referral sources with residential real estate closings.
Our real estate practice also includes issuing title insurance in connection with purchase and financing transactions, as well as representation of title insurers in defending and/or correcting title-related claims.
